Formulation of a New Consumer Product

(1) Select at least one typical unpatented consumer product and obtain literature and MSDS information for the product. Review and compare all available literature, specification sheets, price information, directions, claims, and packaging. Our fee: $300.00. Client can also do the review and forward information to laboratory. If product is patented, it may be possible to make a better product.

(2) Evaluate the product based on the MSDS data and label information to determine if the product has components likely to be effective, to be non-toxic, and to have lower cost. Fee: ca. $150.00.

(3) Test the product and run appropriate performance tests of the formula. Fees to be determined depending on the tests needed.

(4) Evaluate the performance results and, if good, conduct a deformulation by separations and chemical analysis to determine the ingredients and their levels.
Deformulation of a very simple product may cost as little as $900.00.
Deformulation of a complex mixture may cost $2000.00 or more.

(5) If needed, we will evaluate the stability of the product and conduct an accelerated stability test, e.g. (1) 25 to 40 deg. C., (2) 50- 95% relative humidity, and (3) 14 days to 2 years. Organoleptic, physical, chemical, microbiological, or many other tests are conducted. A fee of $300.00 is generally charged for a three month study.

(6) Formulate a small quantity of the product (e.g. 1 pint) and conduct a performance test to compare with the previous test results. The first trial formulation will typically cost $300.00 plus cost of any expensive ingredients.

(7) If required, refine the formula and repeat the performance test.

(8) Client or lab can evaluate color, texture, odor, viscosity, etc. and review performance data.

(9) Using the final refined formula, run all required physical tests and prepare the MSDS form using the OSHA format. (Fee: $400.00)

(10) Prepare suggested list of claims, warnings, cautions, toxicities, directions, disclaimers, expiration date, and safety information to place on the package.
(Fee is generally $200.00 to $300.00)

Total Fee: $2500.00 to $3000.00

Our laboratory has been successful in helping over 800 clients to develop and perfect chemical and herbal formulas. Several of these have generated several millions in sales. We helped several of the clients obtain patents.

If a good unpatented product is on the market, we can generally make a similar or even improved product for your company or a private label company to manufacture. If you wish to have the product manufactured or private labeled, we will find a reliable firm in South Florida to make your product.

Generally it is less expensive to deformulate (reverse engineer) an existing product and then to just make a similar product. The techniques required to deformulate a product include wet chemistry, physical separation, distillation, thin layer chromatography, ion chromatography, gas chromatography, liquid chromatography, column chromatography, mass spectroscopy, fourier transform infrared spectroscopy, UV/visible spectroscopy, thermal analysis, energy dispersive spectroscopy, emission spectroscopy, atomic absorption spectroscopy, inductively coupled plasma spectroscopy, high performance liquid chromatography, nuclear magnetic resonance spectroscopy, x-ray diffraction, liquid chromatography with mass spectroscopy, and many others.

Our deformulation fee depends on the number and complexity of the components. For example, a product containing 3 simple organic or inorganic components can probably be deformulated for $900.00 to $1200.00. For 4 to 10 simple components, the fee might be $1200.00 to $1800.00 with a turnaround time of 4 weeks. For more complex components or for herbal ingredients, the fee will be higher and the turnaround time will be longer.

Our fees to formulate a small trial batch can range from $200.00 to $600.00 depending on the difficulty. A second or third trial sample may be needed and in a few cases with very complex formulas, over 5 trial samples may be needed.
The art of combining the ingredients and the order of ingredient addition play a big part in making a suitable product. All work is on a best effort basis and the fees are based on the number of hours required ($100.00 per hour) and the cost of the ingredients.

We may be able to help you obtain a patent in your name for the novel product that we develop for you. Our fees for a patent feasibility study, patent search, and patent application are very reasonable. Please call for a quotation.
